What will change for agency workers from 1 January 2026?

From 1 January 2026, Dutch legislation for agency workers will change. These new rules are designed to ensure that agency workers are treated more fairly, equally, and transparently compared to permanent employees.

This means: better employment conditions, more clarity, and a stronger position in the workplace.

Equal and equivalent pay: what does it mean?

One of the most important changes is the principle of equal and equivalent pay.

What does this mean?

If you work as an agency worker and perform the same job as an employee who is directly employed by the company, you will be entitled from 2026 to the same employment conditions.

This includes, among other things:

  • 💶 Salary – equal pay for equal work
  • ⏱️ Allowances – such as shift allowances, irregular hours allowances, or overtime pay
  • 🌴 Holiday days and holiday allowance
  • 🏖️ ADV days (if applicable within the company)
  • 🎁 End-of-year bonuses or bonus schemes (where applicable)
  • 🚗 Travel expense reimbursement
  • 📚 Training and development opportunities

👉 Your employment conditions will therefore align with those of your colleagues on the work floor.

Pension: what is changing?

The pension scheme for agency workers will also be improved.

From 2026:

  • You will build up pension faster
  • The mandatory employee pension contribution will increase from 4% to 7.5%
  • The employer contribution will increase from 8% to 15.9%
  • As a result, agency workers will accumulate pension benefits significantly faster than before
  • The pension scheme will better align with that of permanent employees

This means you benefit not only now, but you also build greater financial security for the future.
